On Oct. 16, a Smithville man was found guilty of sexual indecency by contact with an 11-year-old girl.

Moises Cruz Borja, who was 50 years old at the time the incident occurred in 2003, was sentenced to 10 years probation under the Texas Department of Criminal Justice and fined $5,000.

The case was brought to trial on Oct. 13 before Reva Towslee-Corbet, 335th district judge for Bastrop County. After just a few days of testimony, the jury found Borja, now 56, guilty of the second-degree felony.

According to Bryan Goertz, criminal district attorney for Bastrop County, Borja has a family relation to the now 17-year-old victim.

“It was a typical he said-she said case, where the defendant passively admitted to the offense in the end,” Goertz said.

In addition to his punishment, Borja is required to spend 180 days in a work release program at the Bastrop County Jail. He is also a registered sex offender for life and has to submit to a sex offender treatment evaluation.

“The state was very pleased with the jury verdict,” Goertz said. “It’s not every day that you get to say that, but they reached it quickly and in our favor.”

Goertz said that these types of cases are fairly common in Bastrop County, most of them involving two individuals who know each other on some level.
